These Terms and Conditions (“Terms”) outline the rules and regulations for the use of our LMS. By accessing or using the LMS, you agree to comply with these Terms. Please read them carefully before using the LMS. These Terms are a legally binding contract between you and IFSI regarding your use of the LMS and its contents.
By accessing and using the LMS, you acknowledge and agree to be bound by these Terms and any additional guidelines, policies, or rules that may be posted on the LMS from time to time.
a. To access certain features of the LMS, you may be required to create an account. You agree to provide accurate and complete information during the registration process, and to update your information to keep it accurate and complete. b. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
a. You agree to use the LMS only for lawful purposes and in accordance with these Terms. b. You will not upload, post, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. c. You agree you are over the age of 18 and can form a binding contract with IFS Institute, Inc. d. You agree that your enrollment and your use of the LMS complies with any and all applicable laws and regulations. If you are an entity, organization, or company, the individual accepting these Terms on your behalf represents and warrants that they have authority to bind you to these Terms and you agree to be bound by these Terms.
a. All content provided through the LMS, including but not limited to text, graphics, videos, and course materials, is the property of IFSI or its content providers and is protected by copyright and other intellectual property laws. b. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the LMS without our prior written consent. c. Subject to your complete and ongoing compliance with these Terms, IFSI grant you a limited, personal, non-exclusive, non-transferable, and revocable license right to use our LMS and the material accessed therein. The rights granted herein are only for your personal, non-commercial use, unless you obtain our written permission otherwise. Using our LMS does not give you ownership of or any intellectual property rights to the content provided through the LMS or the content you access.
a. Enrollment in courses may require payment of a fee and applicable taxes. Payment details and methods will be provided during the enrollment process. IFSI reserves the right to determine pricing for the courses. IFSI at its sole discretion, may make promotional offers with different features and different pricing available to any of IFSI’s business partners or customers. These promotional offers, unless made to you, will not apply to you, and IFSI reserves the right to revoke a promotional offer in the event that we determine you are not eligible. b. Payments are non-refundable unless otherwise stated in the course description or as required by applicable law. c. If your payment method fails or your account is past due, we may collect fees using other collection mechanisms. d. Professional licensure, certification, and job requirements for various professions may vary in each state, and job requirements may vary by employer. IFSI does not guarantee licensure, certification or qualification for any profession or job on the basis of your completion of content on our LMS. IFSI through its own separate certification process only certifies that those who have met specific requirements are knowledgeable on the IFS psychotherapy model. You are advised to research, understand, and comply with the requirements in the applicable state in which you work, or intend to work, and to investigate whether the content in which you intend to enroll meets your professional needs before enrolling.
a. We collect and process personal information in accordance with our Privacy Policy. By using the LMS, you consent to the collection and use of your information as described in the Privacy Policy. b. You are responsible for maintaining the security of your personal information and should not share your login credentials with others.

We reserve the right to terminate, disable, or suspend your account and access to the LMS at our sole discretion, without notice, for any reason or no reason, including if you violate these Terms. b. Upon termination: (a) your access to the LMS and any related content will cease; (b)your license and all corresponding rights will terminate, and you must immediately cease all use of the LMS; and (c)you must pay IFSI any unpaid amount that was due prior to termination.
We reserve the right to modify or discontinue the LMS, or any part thereof, at any time without notice.
These Terms and your use of the LMS shall be governed by and construed in accordance with the laws of Illinois, without regard to its conflict of law principles. You and IFSI will submit to the personal jurisdiction of and exclusive venue in the federal and state courts located in and serving Cook County, Illinois as the legal forum for any such dispute.
To the maximum extent permitted by law, the LMS and all included content are provided on an “as is” basis without warranty of any kind, whether express or implied. IFSI specifically disclaim any and all warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising out of course of dealing or usage of trade. IFSI further disclaim any and all liability related to your access or use of the LMS or any related content. You acknowledge and agree that any access to or use of the LMS or such content is at your own risk.
To the maximum extent permitted by law, IFSI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the LMS; or (b)unauthorized access, use, or alteration of your content or information. In no event shall IFSI aggregate liability for all claims related to the LMS exceed twenty U.S. Dollars ($100) or the total amount of fees received by IFSI from you for the use of paid LMS content during the past six months, whichever is greater. You acknowledge and agree that the disclaimers and the limitations of liability set forth in these Terms reflect a reasonable and fair allocation of risk between you and IFSI, and that these limitations are an essential basis to IFSI’s ability to make the LMS and its content available to you on an economically feasible basis. You agree that any cause of action related to the LMS or its related content must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
Please read the Privacy Policy carefully for information relating to our collection, use, storage, and disclosure of your personal information. The Privacy Policy will be reviewed and updated from time to time. When we do make material changes, we will give notice via the LMS site or by otherwise notifying you. The Privacy Policy is incorporated by this reference into, and made a part of, these Terms.

To the fullest extent permitted by law, you are responsible for your use of the LMS, and you will defend and indemnify IFSI, its affiliates, and their respective shareholders, directors, managers, members, officers, employees, consultants, and agents (together, the “IFSI Entities”) from and against every claim brought by a third party, and any related liability, damage, loss, and expense, including attorneys’ fees and costs, arising out of or connected with: (a) your unauthorized use of, or misuse of, the LMS or its contents; (b) your violation of any portion of these Terms, any representation, warranty, or agreement referenced in these Terms, or any applicable law or regulation; (c) your violation of any third-party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; or (d) any dispute or issue between you and any third party. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in that case, you agree to cooperate with our defense of those claims.
We reserve the right to revise the Terms at our sole discretion at any time. Any revisions to the Terms will be effective immediately upon posting by us. For any material changes to the Terms, we will take reasonable steps to notify you of such changes, via a banner on the website, email notification, another method, or combination of methods. In all cases, your continued use of the LMS after publication of such changes, with or without notification, constitutes binding acceptance of the revised Terms.
If it turns out that a particular provision of these Terms is not enforceable, this will not affect any other terms. If you do not comply with these Terms, and we do not take immediate action, this does not indicate that we relinquish any rights that we may have (such as taking action in the future).
IFSI respects and expects its users to respect the rights of copyright holders. On notice, IFSI will act appropriately to remove content that infringes the copyright rights of others. If it is believed that any content uploaded infringes upon existing copyrights, owners or any agent may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing us with the following information in writing (see 17 U.S.C. 512(c)(3) for further detail): (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing or to be the subject of infringing activity sufficient to permit IFSI to locate the material; (d) information reasonably sufficient to permit IFSI to contact you, such as an address, telephone number, and, if available, an electronic mail; (e) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. These Terms constitute the entire agreement between IFSI and you pertaining to the subject matter of this Agreement. In its sole discretion, IFSI may modify these Terms by posting the revised version on this site and you agree that each visit by you to this site is a new transaction governed by the Terms and Conditions linked on this site at that time. IFS Institute, Inc. (“IFSI”, “we”, “our”, or “us”) is committed to safeguarding your privacy. Our LMS provides you with the ability to pay for courses and other services using a credit card or other methods through a third-party payment processing service provider. Please note that our service provider-not the LMS-collects and processes your financial information.

Usage Data: We may collect and aggregate necessary information about your interactions with the Learning Management System, including your course progress, quiz results, time spent on the platform, and other activity data. This information may include, among other things, your name and email address.

Device and Log Data: We automatically collect information about your device, including IP address, browser type, operating system, and other technical data when you access our Learning Management System. We may be able to determine from an IP address a user’s Internet Service Provider and the geographic location of their point of connectivity. Location data may be used to route your traffic to the nearest regional server to reduce latency and improve your experience. We may also use cookies and web beacons when you visit our Site.

If you are under the age of majority for your state, then please do not use or access this Site at any time or in any manner.
